When you're financially comfortable making child support payments, it's easy to look at your situation and realize that you're doing something that benefits the lives of your children.

Conversely, if your financial situation takes a turn for the worse, you may come to find it difficult to make child support payments.

A child support modification may be necessary. However, obtaining this isn't as easy as it sounds. If you're interested in going down this path in Memphis, here are some tips to follow:

  • Don't waste any time: If you're unable to make your child support payments, don't wait to request a modification. The court requires you to keep up with payments until a modification is approved. Furthermore, you're responsible for any unpaid amounts.
  • Attempt to reach a new agreement with the other parent: This person doesn't have the legal power to approve a child support modification, but if they're on your side, there's a better chance the court will be as well.
  • Keep making payments: Even if you can't make payments in full, do your best to keep up. If you don't put forth a strong effort, it could hurt your ability to receive a modification.
  • Prove that you need a modification: The court won't approve a child support modification unless you can prove a change in circumstances. Common examples include a job loss, reduced income and serious illness. Anything you can do to document your change in circumstances is something to consider.
  • File your request: File your child support modification request with the court that originally issued your order. Any papers you file with the court must be served to the other parent, to make them aware of your plans.

Just because you strongly believe you have a case for a child support modification doesn't necessarily mean the court will agree. This is why it's so important to take the right steps, including documenting your change in financial circumstances.
